Terms of Service

1. General Provisions

These Terms of Service set out the rules for providing electronic services by AniOla Beauty Space available at www.aniola-beautispace.pl. The Terms have been developed in accordance with the Act of 18 July 2002 on providing services by electronic means (Journal of Laws 2020, item 344) and the Act of 30 May 2014 on consumer rights (Journal of Laws 2020, item 287).

Email address: aniolabeautyspace@gmail.com. NIP: 8661747237. The seller conducts business activity in the field of cosmetics and skin care products sales.

3. Types and Scope of Electronically Provided Services

The seller provides the following electronic services: 1) Providing access to a website enabling browsing of cosmetic products offer, 2) Operating an online store enabling placing orders for products available in the offer, 3) Operating a user account enabling order management, purchase history and preferences, 4) Sending newsletter with information about products and promotions (with user consent), 5) Handling complaints and returns electronically, 6) Skin analysis tool using artificial intelligence (Face AI). All services are provided free of charge, except for the product sales service, which is paid according to prices specified in the offer.

4. Technical Requirements

To use electronically provided services, the user should have: 1) A device with Internet access (computer, tablet, smartphone), 2) A web browser supporting JavaScript and cookies (recommended: latest versions of Chrome, Firefox, Safari, Edge), 3) Cookies enabled in the browser, 4) Internet connection with speed enabling website use, 5) In case of placing orders - an active email address. The seller is not responsible for technical problems resulting from incorrect configuration of the user's device or browser.

5. Prohibition on Publishing Illegal Content

The user undertakes not to publish content in the service that is illegal, in particular: content violating copyright or intellectual property rights, offensive, vulgar, discriminatory or inciting hatred content, advertising content without the seller's consent, content containing viruses, trojans or other malicious software, content violating personal rights of other persons, misleading or false content. In case of violation of the above prohibitions, the seller has the right to immediately remove the content and block the user's access to the service, without refund of costs.

6. Conclusion and Termination of Electronic Services Agreement

The agreement for providing electronic services is concluded at the moment the user starts using the service. The user accepts the Terms by starting to use the service. The agreement is concluded for an indefinite period. The user may at any time resign from using the services by deleting the account (if created) or ceasing to use the service. The seller reserves the right to terminate the agreement with the user in case of violation of the Terms, in particular in case of publishing illegal content. In case of termination of the agreement due to user's fault, the seller does not refund any costs incurred by the user.

7. Complaint Procedure

Complaints regarding electronically provided services can be submitted: 1) Electronically to the email address: aniolabeautyspace@gmail.com, 2) By mail to the address: ul. Krzywda 17g 5, 30-720 Kraków, Poland, 3) By phone at: +48 739 684 873. The complaint should contain: user's first and last name, email address or phone number, description of the problem or non-compliance, user's request, date of the problem occurrence. The seller considers the complaint within 14 days from the date of its receipt. The response to the complaint will be sent to the email address provided in the complaint or in another way indicated by the user. In case of positive consideration of the complaint, the seller will take actions to remove the defect or refund costs, if applicable.

8. Final Provisions

The seller reserves the right to make changes to the Terms. Users will be informed about changes by publishing an updated version of the Terms on the website. In case of significant changes, users will receive an additional notification by email. Continued use of the service after changes are made means acceptance of the new Terms content. Matters not regulated in these Terms are governed by Polish law, in particular the Civil Code and the Act on providing services by electronic means. All disputes will be resolved by courts competent under Polish law.
